An intermediate level presentation on the substantive issues affecting real estate attorneys handling transactions involving exchanges of property held for investment or for trade or business purposes. Like-kind exchanges under Section 1031 of the Internal Revenue Code may allow taxpayers to defer the tax on the gain that would otherwise be due on the sale of real property.

This seminar will be useful to attorneys who advise clients on the sale and purchase of real property or to those who provide related services such as accountants, brokers, and other real estate professionals.

The topics include: the new safe harbor regulations (effective March 10, 2008) for exchanges of dwelling units such as vacation homes, the statutory requirements of Section 1031 for exchanges, the 1991 safe harbor regulations for forward exchanges, reverse exchanges under Rev. Proc. 2000-37, and practice tips, such as dealing with purchase money mortgages, trust account issues, and selection of a qualified intermediary.
